Recently, Mr. Miller’s group filed a lawsuit against Arizona’s largest public school district based in Mesa. The complaint stated that the district has a policy that encourages students to change their gender identification without notifying parents. It also raised concerns about potential outcomes such as sexual violence and genital mutilation.
The lawyer representing the Mesa district, Robert D. Haws, refrained from commenting due to the ongoing litigation. However, in a motion to dismiss the case, he argued that the claims made by America First Legal were exaggerated and that the district’s policy aims to prevent discrimination, including against transgender students.
Past litigation by Mr. Miller’s group has faced criticism for its timing. For example, a lawsuit against San Antonio City Council was filed months after Chick-fil-A abandoned plans for an airport location. Additionally, a recent lawsuit against New York University on behalf of a white male law student has been contested by the school’s lawyers for engaging in speculative claims about the selection process.
Legal experts, like N.Y.U. law professor Kenji Yoshino, have criticized America First Legal for prioritizing political agendas over legal merit. The group has yet to argue a case before the Supreme Court and has not achieved significant success in thwarting the Biden administration’s initiatives.
During a recent federal court hearing, Judge Aileen M. Cannon dismissed arguments made by Mr. Miller’s group in an amicus brief regarding the Trump documents case, calling them a distraction.
